Terms of Use

These Terms of Use describe the conditions on which you conclude online transactions for products and services by using the website, mobile site, mobile application and other online transaction portals of GlamAfric Beauty Shop. These Terms of Use, the Cookie Policy, the Privacy Policy, and any other transactional policy (including the Seller’s Policy where applicable) identified now and in the future, collectively form the entire agreement (this “Agreement”) for the use of the GlamAfric Beauty Shop platforms and services.

GlamAfric Beauty Shop (also referred to as “the Beauty Shop” within this Agreement)  is a region-specific product which is owned and operated by Chayse Labs Limited.

Please read these terms carefully before using the GlamAfric Beauty Shop. Usage of the GlamAfric Beauty Shop signifies express agreement to be bound by the terms contained in this Agreement.

 

The GlamAfric Beauty Shop offers services such as: seller or buyer profiles/accounts on mobile applications, etc. All services offered by the Beauty Shop  are subject to this Agreement.

SCOPE OF APPLICATION AND ACCEPTANCE OF TERMS

  • Contracting Party: This Agreement is entered into between you (also referred to as “Member” or “User” hereinafter) and Chayse Labs Limited (owner and operator of GlamAfric Beauty Shop). If you are from outside Nigeria, you are contracting with Chayse Labs Limited (incorporated in Nigeria with Company Reg. No. RC1592139).
  • Transaction Policies: GlamAfric Beauty Shop provides an online transaction platform and ancillary services on all its platforms (such platform and services, the “Services”) which allow registered members to conclude online transactions for products or services within the Sites subject to the terms of this Agreement. GlamAfric Beauty Shop may publish transaction policies, which include dispute policies, for any type of online transactions and any subsequent amendments or modifications of the transaction policies as may be made from time to time.  Such transaction policies are expressly incorporated into this Agreement by reference and you agree to be bound by such policies.
  • Entire Agreement. This Agreement, including all the above identified policies, form a legally binding agreement between you and GlamAfric Beauty Shop in relation to your use of the services and platforms provided by the Beauty Shop. By accessing and using any of the services and platforms, you agree to accept and be bound by this Agreement.  Please do not use the Beauty Shop services and platforms if you do not accept all of the terms of this Agreement.
  • GlamAfric Beauty Shop may amend any terms of this Agreement at any time by posting the relevant amended and restated version on its platform(s). The amended terms shall be effective immediately upon posting.  We will endeavor to give advance notice of material changes to this Agreement.  By continuing to use the services, you agree that the amended terms will apply to you.  This Agreement may not otherwise be amended except in writing by an authorized officer of GlamAfric Beauty Shop or Chayse Consulting Limited.
  • Additional Terms. In some cases, you may be required to additionally enter into a separate agreement with GlamAfric Beauty Shop in connection with particular or unique transactions.  If there is any contradiction between the provisions of this Agreement and the provisions of the Additional Terms, the Additional Terms shall govern that particular or unique transaction as appropriate.

OUR ROLE

GlamAfric Beauty Shop operates as a marketplace to allow third party sellers to list and sell their products for purchase by third party buyers at https://.glamafric.com/beautyshop. While GlamAfric Beauty Shop is a service provider that provides the platform to facilitate transactions that are carried out on the website, we are neither the buyer nor the seller of the seller’s items.

GlamAfric Beauty Shop provides a service for sellers and buyers to negotiate and complete transactions. Accordingly, the contract formed at the completion of a sale for these third party products is solely between buyer and seller. GlamAfric Beauty Shop is NOT a party to this contract nor do we assume any responsibility arising out of or in connection with it. GlamAfric Beauty Shop is not an agent or employer of the seller or buyer and does not carry itself as such.

The seller is responsible for the sale of the products and for dealing with any buyer claims or any other issue arising out of or in connection with the contract between the buyer and seller (including returns, exchanges and refunds).

OUR LIABILITY

We will do our utmost to ensure that availability of the Beauty Shop services will be uninterrupted and that transmissions will be error-free. However, due to the nature of the internet, this cannot be guaranteed.

Your access to the Beauty Shop services may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

GlamAfric Beauty Shop will NOT be responsible for:

  1. Losses that were not caused by any breach on our part;
  2. Any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure); or
  3. Any indirect or consequential losses that were not foreseeable to both you and us when you commenced using the Beauty Shop services.

GlamAfric Beauty Shop does not assume any responsibility or liability for the actions, product, and content of all sellers and buyers. We may share your information related to your transactions with third parties involved in those transactions. You should carefully review their privacy policies and terms of use.

COMMUNICATION WITH US

When you use any of the Beauty Shop services or attempt to communicate with us, you are communicating with us electronically. We will communicate with you electronically also in either of the following ways: by email, text, in-app push notices or by posting e-mail messages or communications on the website. For contractual purposes, you agree that all agreements, notices, disclosures and other communications that we provide you electronically satisfy any legal requirement that such communications be in writing, unless mandatory applicable laws specifically require a different form of communication.

PERSONALISATION

As part of the Beauty Shop services, we personalise your experience by identifying your preferences, and making recommendations of features, products, and services, including third party advertisements that might be of interest to you.

COPYRIGHT AND TRADEMARK PROTECTION

All content included in or made available through any Beauty Shop services, such as text, graphics, logos, icons, images, audio and video clips, digital downloads and data compilations is the property of GlamAfric Beauty Shop or its content suppliers. These contents are protected by Copyright Law of Nigeria. The compilation of all content included in or made available through any of the Beauty Shop services is the exclusive property of GlamAfric Beauty Shop and is protected by the Copyright Law of Nigeria.

You may not extract and/or re-utilise parts of the content of the Beauty Shop services without our express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of the content of any the Beauty Shop services, without our express written consent. You may also not create and/or publish your own database that features substantial parts of any of the Beauty Shop services (e.g. our prices and product listings) without our express written consent.

In addition, there are trademarks of GlamAfric Beauty Shop. These may not be used in connection with any product or service that does not belong to GlamAfric Beauty Shop, in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits GlamAfric Beauty Shop. All other trademarks not owned by GlamAfric Beauty Shop that appear in any of the Beauty Shop services are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by GlamAfric Beauty Shop.

LICENCE AND ACCESS

Subject to your compliance with these Terms of Use and your payment of any applicable fees, GlamAfric Beauty Shop or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and make personal and non-commercial use of the the Beauty Shop services.

This licence does not include any resale or commercial use of any the Beauty Shop services or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any the Beauty Shop services or its contents; any downloading or copying of account information for the benefit of another person; or any use of data mining, robots, or similar data gathering and extraction tools.

All rights not expressly granted to you in these Terms of Use are reserved for and retained by GlamAfric Beauty Shop or its licensors, suppliers, publishers, rights holders, or other approved content providers. No whole or part of any of the Beauty Shop services, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent.

You are prohibited from framing or using framing techniques to enclose any trademark, logo or other proprietary information (including images, text, page layout, or form) of GlamAfric Beauty Shop without our express written consent. You are prohibited from using any meta tags or any other “hidden text” utilising the Beauty Shop’s copyrights or trademarks without our express written consent.

You may use the Beauty Shop services only as permitted by law, and you shall not misuse the Beauty Shop services in any way. GlamAfric Beauty Shop may terminate any licences granted if you do not comply with these Terms of Use or any added policies.

USE OF YOUR ACCOUNT

You may need your own platform account to make use of certain Beauty Shop services. You will be required to be logged into the account and establish a valid payment method to be linked with your account.

If there is a problem charging your selected payment method, we may charge any other valid payment system linked with your account.

If you use any Beauty Shop service, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer and mobile device. To the extent permitted by applicable law, you agree to accept responsibility for all activities that occur under your account and/or password. You are expected to take all necessary steps to ensure that the password is kept confidential and secure.

You are obligated to inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be used in an unauthorised manner. You are responsible for ensuring that the details you provide us with are correct and complete, and for informing us of any changes to the information you have provided.

You shall not use the Beauty Shop services:

  1. in any way that causes, or is likely to cause, any Beauty Shop services, or any access to it, to be interrupted, damaged or impaired in any way; or
  2. for fraudulent purposes, or in connection with a criminal offence or other unlawful activity; or
  3. to cause annoyance, inconvenience or anxiety to any user of the platform or to the operators of the platform (Chayse Labs Limited).

Chayse Labs Limited reserves the right to refuse service, terminate accounts or remove or edit content if you are in breach of applicable laws, these Terms of Use, or any other applicable policies.

PAYMENTS

You must make payments due under this Agreement on the Beauty Shop Payment Page.

Buyers can confidently make payments for products using our trusted and secure payment gateway provided by our partner, Paystack.

Any payment of products not conducted on the website will not be classified as a GlamAfric Beauty Shop transaction.

We may offer refunds, in our discretion:

  • Upon Confirmation from the seller that a refund has been agreed on by both parties;
  • In respect of the product price;
  • local and/or international shipping fees; and
  • By way of store credits and wallet refunds, or such other method as we may determine from time to time.

DATA PRIVACY

We know your personal information is important to you, so it’s important to us. Our Privacy Policy and Cookie Policy detail how your information is collected and used when you use the Beauty Shop. By using our services, you also agree that we can process your information in the ways set out in the Privacy and Cookie Policies.

INDEMNIFICATION

You hereby indemnify us, and undertake to keep us indemnified, against:

  1. any and all losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by us to any third party in settlement of a claim or dispute) incurred or suffered by us and arising directly or indirectly out of your use of our Beauty Shop, or any breach by you of any provision of these terms of use, policies or other applicable agreements (seller agreement); and
  2. any VAT liability or other tax liability that we may incur in relation to any sale, supply or purchase made through our Beauty Shop, where that liability arises out of your failure to pay, withhold, declare or register to pay any VAT or other tax properly due in any jurisdiction.

DELIVERY OF PURCHASED PRODUCTS

Sellers are responsible for dispatching their sold items to buyers and for making sure that buyers receive their orders.

OTHER COMMUNICATIONS AND CONTENT ON THE PLATFORMS

Users and visitors of the Beauty Shop platforms may post reviews, comments and other content; submit suggestions, ideas, comments, questions or other information, as long as the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of, or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any form of “spam”.

We reserve the right to remove or edit such content.

You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. If you believe that any content on or advertised for sale on the Beauty Shop platform contains a defamatory statement, or that your intellectual property rights are being infringed by an item or information on any Beauty Shop platform, please notify us by completing and submitting the appropriate notice form and we will take action accordingly after our investigation.

If you post customer reviews, comments, customer questions or answers, or other content generated by you for display on the website (including any images, video or audio, all together “content”), you grant GlamAfric Beauty Shop:

  • the non-exclusive, royalty-free licence to use, reproduce, publish, make available, translate and modify such content throughout the world (including the right to sublicense these rights to third parties);
  • the right to use the name that you submit in connection with such content.
  • No moral rights are transferred by this provision.

You may delete your content from public view or, where such functionality is offered, change settings so that it is only shown to people to whom you grant access.

You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is posted:

  1. the content and material is accurate;
  2. use of the content and material you supply does not breach any applicable policies and will not cause injury to any person or entity (including that the content or material is not defamatory);
  3. You agree to indemnify GlamAfric Beauty Shop for all claims brought by a third party against GlamAfric Beauty Shop or Chayse Labs Limited arising out of or in connection with the content and material you supply on the Beauty Shop platform.

WARRANTIES

We are dedicated to making our services the best they can be, but we are not perfect and sometimes things can go wrong. you understand that our services are provided “as is” and without any kind of warranty (express or implied). We are expressly disclaiming any warranties of title, non-infringement, merchantability, and fitness for a particular purpose, as well as any warranties implied by a course of performance, course of dealing, or usage of trade.

We do not guarantee that:

  1. the services will be secure or available at any particular time or location;
  2. any defects or errors will be corrected;
  3. the services will be free of viruses or other harmful materials; or
  4. the results of using the services will meet your expectations.

You use the services solely at your own risk. Some jurisdictions may not allow limitations on implied warranties, so the above limitations may not apply to you.

TERMINATION

When we permit the registration of an account on our Beauty Shop platform, such an account will remain open indefinitely, subject to this Agreement.

  • Termination By You:

We would hate to see you go, but you may terminate your account at any time from your account settings, subject to the repayment of any outstanding bills and/or settling of accounts with us or any user you are still in a transaction with.

Terminating your account will not affect the availability of some of your content that you posted through the Beauty Shop platforms prior to termination.

  • Terminations By Us:

If you breach, or we reasonably suspect that you have breached, the terms of this Agreement (including policies and seller agreement) in any way, we may:

  1. temporarily suspend your access to the Beauty Shop platform;
  2. permanently prohibit you from accessing the Beauty Shop platform;
  3. block computers using your IP address from accessing our Beauty Shop platform;
  4. suspend or delete your Beauty Shop account; and/or
  5. commence legal action against you, whether for breach of contract or otherwise.

Where we suspend, prohibit or block your access to the Beauty Shop, or a part of it, you must not take any action to circumvent such suspension or prohibition or blocking (including without limitation creating and/or using a different account).

APPLICABLE LAW

These conditions are governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

AMENDMENTS AND SEVERABILITY

We reserve the right to make changes to the Beauty Shop Agreement (policies and terms of use) at any time. You will be subject to the Terms of Use and Policies in force at the time that you use the Beauty Shop services. If any of the terms in this Agreement is deemed invalid, void, or for any reason unenforceable, that term will be deemed severable and will not affect the validity and enforceability of the remaining terms.

WAIVER

If you breach this Agreement, in part or in its entirety, and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach this Agreement.

ASSIGNMENT

You hereby agree that we may assign, transfer, sub-contract or otherwise deal with our rights and/or obligations under this Agreement.

You may not, without our prior written consent, assign, transfer, sub-contract or otherwise deal with any of your rights and/or obligations under this Agreement.

 

THIRD PARTY RIGHTS

A contract under this Agreement is for our benefit and your benefit, and is not intended to benefit or be enforceable by any third party. The exercise of a party’s rights under this Agreement is not subject to the consent of any third party.

CHILDREN

We do not sell products to be purchased by children. We may sell children’s products however, they are to be purchased by adults. If you are under 18 years you may only use the Beauty Shop services with the active supervision of a parent or guardian.

SELLERS’ AGREEMENT WITH GLAMAFRIC BEAUTY SHOP

To operate a seller’s account on the GlamAfric Beauty Shop, please be aware that you are required to consent to a Sellers Policy that will be made available to you upon application. That policy, in addition to this Terms of Use, the Cookie and Privacy Policies will form the entire agreement between us and a seller on this Beauty Shop platform.

SELLER PRODUCT LISTINGS

Please keep in mind that Seller product listings are merely hosted on the Beauty Shop platform and are posted solely at the direction of the Sellers who may be contacted via their Seller Information page.

USE OF THIRD PARTY SERVICES

When you make use of the GlamAfric Beauty Shop platform, you may also be using the services of one or more third parties, such as a wireless carrier, a mobile platform provider, or a payment systems provider. Your use of these third party services may be subject to the separate policies, terms of use of these third parties.

DISPUTE RESOLUTION

  • Disputes with other users or other parties:

If you find yourself in a dispute with another user of the Beauty Shop services or a third party, we encourage you to contact the other party and try to resolve the dispute amicably.

The Beauty Shop will attempt to help you resolve disputes in good faith and based solely on our interpretation of our policies, and in our sole discretion.

We will not make judgments regarding legal issues or claims.

GlamAfric Beauty Shop has no obligation to resolve any disputes between users or other parties.

RELEASE OF GLAMAFRIC BEAUTY SHOP: You hereby release us from any claims, demands, and damages arising out of disputes with other users or parties.

  • Disputes with GlamAfric Beauty Shop:

Any dispute relating to this Agreement which cannot be resolved by negotiation between the parties within 14 days of either party giving notice to the other party that a dispute has arisen shall be submitted by any party for final resolution by arbitration by one (1) neutral arbitrator to be appointed by the Lagos Chamber of Commerce International Arbitration Centre (LACIAC), conducted in Lagos State in English language, and in accordance with the Arbitration Rules of LACIAC.

SERVICE UPDATES

In order to keep the GlamAfric Beauty Shop services up-to-date, we may offer automatic or manual updates at any time and without notice to you.

Seller Agreement

February, 2021.

This Seller Agreement together with the Privacy Policy forms part of the Terms of Use for the GlamAfric Beauty Shop.

Thank you for using GlamAfric Beauty Shop web-based platform. This Seller Policy describes additional conditions on which you interact and utilise the website, mobile site, mobile application and other online transaction portals of GlamAfric Beauty Shop as a seller rather than as a buyer. This Seller Policy in addition to the Terms of Use, the Cookie Policy, the Privacy Policy, and any other transactional policy identified now and in the future, collectively form the entire agreement (this “Agreement”) for the use of the GlamAfric Beauty Shop platforms and services as a seller operating a seller account.

Please read the entire agreement carefully before opening a seller account and selling your products on the GlamAfric Beauty Shop. Usage of the GlamAfric Beauty Shop signifies express agreement to be bound by the terms contained in the Agreement.

THIRD-PARTY SERVICES

GlamAfric Beauty Shop has engaged third-party service providers to perform many of the services related to payment processing, including card processing, disbursements, currency exchange, identity verification, fraud analysis, and regulatory compliance. The Beauty Shop may share your personal or transactional information with those third-party service providers for purposes related to payments processing.

By using a third-party service, you may also be subject to an agreement with the third party.

SELLERS’ RIGHTS AND RESPONSIBILITIES

  • Seller Account and Unique Online Store: As a seller, you get access to a free seller account opened with correct registration details provided by you. Please note that your Seller Information Page must be kept up to date to ensure that buyers have the right information at all relevant times, and are not misled. You will get a unique store link (URL) that takes buyers straight to your online store.
  • Access to great stock management and order management tools to efficiently run your business on the Beauty Shop platforms.
  • Access to Beauty Shop Payment Services: Your online store will accept payment through authorised credit and debit card transactions via the Beauty Shop payments services. You must provide all required information and complete all required steps for compliance purposes in order to receive remittances from the Beauty Shop.
  • Privacy and Protecting Personal Information: You are responsible for protecting users’ personal information you receive or process, and you must comply with the requirements in this Policy, our Terms of Use, Cookie Policy, and Privacy Policy.
  • Sellers are responsible for promoting their online store to their customers.

 

PAYMENT, PRICING AND COMMISSION

GlamAfric Beauty Shop reserves the right to add or remove accepted payment methods, with notice where required by applicable law.

GlamAfric Beauty Shop payment services only available to sellers who are 18 years old and above, and who provide valid nominated bank details and acceptable identification. It is your duty as a seller to provide only accurate information.

Sellers may only use Beauty Shop payment services for the sale of items advertised on the Beauty Shop platforms, and agree to dispatch sold items once a payment transaction is complete and reflected in their payment account.

The Beauty Shop reserves the right to terminate a seller’s access if the seller uses the payment services in any other manner.

It is free to set up your unique online store on the Beauty Shop platform.

GlamAfric Beauty Shop will charge a 5% commission on total sales and any delivery charges. GlamAfric Beauty Shop reserves the right to change the commission percentage at any time. Any such change will be communicated to the seller for a chance to accept or reject the change. Any rejection of a change in commission percentage will result in grounds for terminating the seller’s agreement and account. The seller bears the responsibility to terminate this agreement in the above instance. Continued use of the Beauty Shop services or platform after a change in commission will signify acceptance of the change.

Sellers are responsible for setting their own prices at all times.

All payments on the Beauty Shop platforms will be processed by GlamAfric Beauty Shop using PayStack Payment Gateway and funds will be remitted to sellers’ nominated accounts on a daily basis.

PAYMENT PROCESSING FEES

GlamAfric Beauty Shop will take on the processing fees due to the payment partner, Paystack. The seller will have no direct financial obligation to Paystack. All charges due from the seller will be included in the commission charged.

 

VAT

GlamAfric Beauty Shop may be required to charge VAT on seller fees accrued each month and remit it to the relevant tax authority. Sellers are thereby advised to consider this when deciding on product pricing.

When this is done, GlamAfric Beauty Shop will ensure the seller receives a statement of remittance to enable the seller accurately audit its general business tax liabilities.

 

PAYMENT SECURITY MEASURES

The Beauty Shop may impose transaction limits on sellers. For example, we may impose limits relating to the value of any transaction, deposit, or adjustment, or limits relating to the cumulative value of all transactions, deposits, or adjustments during a period of time. We may also impose limits related to the number of transactions per day or other period of time. We will not be liable to a seller: (a) if we do not proceed with a transaction, deposit, or adjustment that would exceed any limit established by us, or (b) if we permit a buyer to withdraw from a transaction.

The Beauty Shop may refuse payment services to anyone, for any reason, at any time.

The Beauty Shop reserves the right to decline or refund transactions that we believe to be high risk, fraudulent, in violation of trade sanctions, or otherwise in violation of this agreement as a whole.

In the event that a buyer makes payment for the purchase of a legitimate item using a stolen or unauthorised debit/credit card, the Beauty Shop may provide limited payment protection to the seller, in the interest of fairness.

DELIVERY, RETURNS AND EXCHANGES

Sellers are responsible for ensuring delivery of purchased products to the buyers.

Sellers are responsible for processing and arranging returns and exchanges of purchased products where applicable.

REFUNDS

Sellers are responsible for processing refunds to customers in a timely manner. Customer payments will be remitted to you “the seller” within 24hours, (Less 5% commission)

Glamafric Beauty Shop can process these refunds on instruction from the seller only where funds payable to the seller from sales on the Beauty Shop platform are still in the possession of the Beauty Shop and are due to be remitted to the seller in the next daily remittance period. This refund can only be processed by the Beauty Shop if the funds in its possession, belonging to the seller in question, is sufficient to make such a refund, otherwise, refunds will be made by the seller to the buyer in a timely manner. Please note that it is still subject to the 5% commision.

QUALITY OF PRODUCTS ADVERTISED AND SOLD

GlamAfric Beauty Shop is not responsible for the quality of products advertised and eventually sold.

Sellers expressly warrant that the quality of products advertised and sold will be fully disclosed to buyers prior to any sale. Such disclosure may be done on the advertisement of products, or in discussions with buyers had on the Beauty Shop platforms prior to the payment of the sale price by the buyer.

GLAMAFRIC BEAUTY SHOP TRANSACTIONS

GlamAfric Beauty Shop transactions are transactions that begin, develop and conclude strictly within the confines of the services provided by the Beauty Shop.

Any advertisement or payment of products not conducted on the website will not be classified as a GlamAfric Beauty Shop transaction and will not be afforded the rights and privileges provided under this Agreement.

 

COMMUNICATION ON THE BEAUTY SHOP PLATFORMS

With the Messaging functionality, you have the ability to communicate directly with your buyers or other Beauty Shop users. Buyers may make use of this function to ask questions about products and you may use this function to respond to questions and provide full disclosure about products to individual buyers prior to payment being made.

Messages may not be used for the following activities:

  1. Sending unsolicited advertising or promotions, requests for donations, or spam;
  2. Harassing or abusing another user;
  3. Contacting someone after they have explicitly asked you not to; or
  4. Interfering with a transaction or the business of another user. Interference occurs when a seller intentionally interferes with another seller’s shop in order to drive away their business. Interference is strictly prohibited on GlamAfric Beauty Shop. Examples of interference include:
  • Contacting another user via the messaging functions to warn them away from a particular user, shop, or item. (All valid concerns about the genuineness of a buyer or another seller should be addressed directly to the Beauty Shop Team);
  • Posting in public areas to demonstrate or discuss a dispute with another user;
  • Purchasing from a seller for the sole purpose of leaving a negative review;
  • Creating or using an independent buyer account to maliciously up-vote another seller’s negative reviews in order to position those reviews more prominently.

5. Harassment: Any use of the Beauty Shop platform to harass other members is strictly prohibited. If you receive a Message that violates this policy, please let us know immediately.

If you are unable to complete a transaction, you must notify the buyer using the in-platform messaging function and cancel the transaction. If the buyer already completed payment for the transaction, you must issue a full refund. You are encouraged to keep proof of any refunds in the event a dispute arises.

FEEDBACK AND DISPUTES

Feedback

Feedback helps to build reputation on the Beauty Shop. Buyers can leave feedback in the form of a review in words, or by using a one to five star rating system plus a photograph of their purchase upon delivery. Buyers can edit their reviews, including the photographs, as they require, and in compliance with their Terms of Use of the Beauty Shop platform.

On the rare occasion that you receive an unfavourable review, you can reach out to the buyer or, if the review is less than 3 stars, leave a response.

Your response to reviews may not:

  1. Contain private information;
  2. Contain obscene, racist, or harassing language or imagery;
  3. Violate any of our Policies;
  4. Contain spam;
  5. Contain threats or extortion;
  6. Use a third party to leave a biased, inauthentic or untruthful positive review; or
  7. Undermine the integrity of the Reviews system.

 

Disputes

Buyers are encouraged to contact sellers directly and attempt to resolve any outstanding issues before bringing a dispute to the GlamAfric Beauty Shop to assist with resolution. For this reason, it is important that you promptly respond to Messages from your buyers. However, sometimes a case may be necessary, and the Beauty Shop will work with you and the buyer to resolve it as quickly as possible. The Beauty Shop may request your assistance in resolving a case opened against your online store.

We reserve the right to decide to refuse to engage, engage, or disengage after engagement in any matter of dispute between buyers and sellers.

By using the Beauty Shop platform, you understand that we may use your personal information for the purpose of resolving disputes with other users. By way of resolving a dispute between you and any of your buyers, you may be required to refund the order.

DELIVERY OF PRODUCTS PURCHASED

Sellers are responsible for dispatching their sold items to buyers. If you make use of a third party delivery or fulfilment service, please keep in mind that you are ultimately responsible for making sure that your buyers receive their orders.

 LIMITED AGENCY RELATIONSHIP

As a seller, you appoint GlamAfric Beauty Shop as your agent for the sole purpose of receiving, holding and settling payments to you as a Beauty Shop Seller. The Beauty Shop will only settle payments that are actually received to each seller, less any amounts owed to the Beauty Shop and subject to these Terms. Each seller agrees that a buyer’s payment received by the Beauty Shop, on behalf of the seller, satisfies the buyer’s obligations to make payment to the seller, regardless of whether the Beauty Shop actually settles such payment to the seller. If the Beauty Shop does not settle any such payments as described in these Terms to a seller, such seller will have recourse only against GlamAfric Beauty Shop and not the buyer.

ACCOUNT AND CONTENT VISIBILITY

In order to keep the Beauty Shop safe and improve our Services, we may take actions that either limit the visibility of your unique online store or your ads, or that impact your payment account. Where we believe that your actions or online store may result in buyer disputes, chargebacks, increased risk of fraud, counterfeiting, or other claims, the Beauty Shop may take actions such as limiting visibility of your account, or placing restrictions or reserves on your payments account. When appropriate and permitted by law, the Beauty Shop will communicate information to the affected seller about the issue.

In the event an online store sees an unusual spike in orders, particularly in a high demand category, that store may see an increase or decrease in its search ranking. Sometimes, if a store sees an increase in fulfilled orders and good reviews, this may result in higher visibility and search rank.

In addition, we may limit the visibility of listings or ads in the interest of keeping the Beauty Shop safe, and/or improving our services.

If the Beauty Shop has reason to believe you, your content, or your use of the our services violate our Terms, including this Seller Policy, we may deactivate that violating content or suspend or terminate your account (and any accounts the Beauty Shop determines is related to your account) and your access to the Beauty Shop platform. Generally, the Beauty Shop will notify you that your content or account has been suspended or terminated, unless you are a repeat violator of our Terms or we have legal or regulatory reasons preventing us from notifying you.

REPORTING OBLIGATIONS

The law may require that we provide information on our sellers to regulatory authorities in certain circumstances. GlamAfric Beauty Shop will comply with the requirements of the law and you agree to release GlamAfric Beauty Shop from any liability arising from any loss, fines or other sanctions arising from our providing such information to the relevant regulatory authorities.

TERMINATION

Sellers may terminate this contract and their acceptance of the Beauty Shop payment service at any time by adjusting the Settings in their account. GlamAfric Beauty Shop may also terminate or suspend a seller’s use of our payment service at any time.

Upon termination, any non-disputed available funds in the possession of the Beauty Shop will be deposited into a seller’s bank account. We reserve the right, upon termination, to set off against any payments to be made to the seller, an amount determined by us to be adequate to cover any anticipated chargebacks, refunds (where we have been instructed by the seller to effect a refund), adjustments or other amounts that might be paid to buyers in connection with purchases from the seller’s payment account for a prospective 180-day period. At the end of the 180-day period following termination, we will disburse to the seller any amount not used to offset chargebacks, refunds, adjustments, or such other amounts paid to buyers, or seek reimbursement from the seller via any of the means authorised in this Policy for any additional amount required to offset chargebacks, refunds, adjustments, or other amounts paid to buyers, as applicable.
